Artwork Commission Agreement Checklist

If you are hiring an artist to create commissioned artworks, or you are an artist providing commissioned works, you must set out exactly what services are required from the artist and what the artist will be paid.  Other issues including delivery requirements, ownership and exclusivity should also be agreed on before the artist commences any work.  Our Artist Commission Agreement Checklist helps you clarify the terms of your artwork commissioning arrangement.

1. Parties to the Contract

A. Describe the artist and artwork commission services.
B. What is the artist's name, address, contact details and ABN (if applicable)?
C. What is the personal or business name, ABN, street address and contact details of the commissioner of the artwork(s)?
D. Provide a description and details of the artwork(s) being commissioned (number, size, medium, colour, shape).

2. Services

A. What specific artistic services will the artist be commissioned to provide?
B. When and where will the services be provided?
C. Will any specific insurances, permits and/or licences be needed by either party?

3. Deliverables and Delivery Date

A. What is the artist required to deliver? (E.g. number of copies, digital files, frames etc.)
B. When must the Deliverables be delivered? If a delivery schedule is required, please provide key dates or time frames for delivery.
C. Are there any requirements or specifications for the deliverables? (E.g. any stylistic or technical specifications.)

4. Fee, Payment Schedule and Expenses

A. What will be the fee/retainer and/or how will the fee/retainer be calculated?
B. When will payment(s) be made? (E.g. 50% on signing and 50% on delivery, etc.)
C. Will any expenses (e.g. for materials, supplies, equipment etc) be reimbursed or covered by the commissioner?
D. Will further fees, costs or rates be charged for any additional services? If so, provide a rate card.

5.Ownership, Control and Exclusivity

A. Who will own and control the artwork(s)?
B. Will there be any restrictions or specifications regarding use or display of the artwork(s)? E.g. Is authorised use by the client limited (even if the client owns the artwork(s))?
C. Will either party be subject to any exclusivity or restriction requirements?


A. Will the artist be credited in connection with the use or display of the artwork(s)? If so, under what circumstances?

7. Termination and Cancellation

A. Under what circumstances (if any) can either party terminate the agreement?
B. How much notice is required from either party to terminate/cancel the agreement?
C. In the event of termination or cancellation, what is the cancellation fee and/or how is it calculated?
D. Are there any special conditions which will apply to the arrangement?
